1. Definitions
"Waterscape Creations", "we", "us" and "our" refers to the business providing luxury pond design, pond construction, water features, landscaping and related services.
"Customer", "you" and "your" refers to any individual or organisation purchasing services from Waterscape Creations.
"Services" refers to all work provided by Waterscape Creations, including pond design, pond construction, pond renovations, water feature installations, consultations, landscaping and associated works.
"Products" refers to any materials, equipment or items supplied as part of our services, including pumps, filtration systems, liners, stone, features and other components.
By accepting a quotation, making a payment or instructing Waterscape Creations to begin work, you agree to these Terms and Conditions.
2. Bespoke Services and Design Process
Many Waterscape Creations projects are individually designed and built to suit each customer's property and requirements.
Before work begins, we will discuss your requirements, budget, preferences and intended use of your pond or water feature.
Where required, we may provide recommendations, concepts, drawings or specifications for approval.
Customers are responsible for providing accurate information regarding their property, access requirements, underground services and any factors that may affect the project.
Any changes requested after approval may result in additional costs and may affect completion times.
3. Quotations and Pricing
All quotations provided by Waterscape Creations are based on the information available at the time of preparation.
Quotations may include:
• Design and consultation costs
• Labour
• Materials
• Equipment
• Installation
• Associated services
If additional work becomes necessary due to unforeseen circumstances, this will be discussed with the customer before any additional work is undertaken.
Additional charges may apply for:
• Changes requested by the customer
• Additional materials
• Unexpected ground conditions
• Additional excavation
• Hidden structures or services
• Changes to the agreed specification
4. Deposits and Payment Plans
Waterscape Creations offers flexible payment options, including payment plans and instalment arrangements, allowing customers to spread the cost of their project over an agreed period.
Payment schedules will be agreed before work begins and confirmed in writing.
Payment plans may include:
• An initial deposit to secure your project
• Scheduled instalment payments
• A final balance payment upon completion
The payment structure, instalment amounts and payment dates will be clearly explained before work begins.
Customers must ensure payments are made on the agreed dates. Failure to maintain payments may result in work being paused until accounts are brought up to date.
5. Use of Customer Payments
Payments received from customers are used to cover project-related costs, including materials, labour, preparation, scheduling and associated expenses.
For bespoke projects, materials may be ordered specifically for your installation once deposits or agreed payments have been received.
6. Refund Policy
Waterscape Creations is committed to providing customers with confidence when investing in their project.
If a project is cancelled or Waterscape Creations is unable to complete agreed works, customers will be entitled to a refund for any payments made relating to work that has not been completed.
Refunds will be calculated based on:
• Work already completed
• Materials purchased or ordered
• Costs already incurred
• Any completed services provided
Any unused balance relating to incomplete work will be refunded.
All refunds will only be issued back to the original payment method or card used to make the payment.
Refunds cannot be transferred to another person, card or alternative payment method.
7. Cancellation of Bespoke Projects
Due to the custom nature of many Waterscape Creations projects, cancellation terms may vary depending on the stage of the work.
Where bespoke materials have been ordered, specialist items purchased or construction has commenced, costs already incurred may be deducted from any refund.
Customers wishing to cancel a project should contact Waterscape Creations as soon as possible.
Nothing within these terms affects your statutory rights under UK consumer law.
8. Project Timescales and Delays
We provide estimated completion times wherever possible.
Due to the outdoor and bespoke nature of pond construction, completion dates cannot always be guaranteed.
Delays may occur due to:
• Weather conditions
• Supplier delays
• Material availability
• Unexpected site conditions
• Circumstances outside our reasonable control
We will always aim to minimise delays and keep customers informed throughout the project.
9. Customer Responsibilities
Customers must ensure:
• Suitable access is available
• Parking and working areas are accessible
• Underground services are identified
• Any relevant permissions are obtained where required
Waterscape Creations cannot accept responsibility for damage caused by undisclosed underground services or hidden obstacles.
10. Installation and Completion
Upon completion, Waterscape Creations will ensure the agreed works have been completed professionally and in accordance with the agreed specification.
Customers should inspect completed works and notify us of any concerns within a reasonable timeframe.
Natural settling, environmental changes and seasonal adjustments may occur as part of outdoor landscaping and water features.
11. Warranties and Guarantees
Waterscape Creations aims to provide exceptional workmanship and uses quality materials wherever possible.
Our workmanship guarantee covers defects caused by installation errors within the agreed guarantee period.
This does not cover:
• General wear and tear
• Accidental damage
• Misuse
• Lack of maintenance
• Damage caused by third parties
• Natural environmental changes
Equipment warranties, including pumps and filtration systems, are subject to the manufacturer's individual warranty terms.
12. Liability
Waterscape Creations will carry out all services with reasonable care and skill.
We are not responsible for losses caused by circumstances outside our reasonable control.
We cannot accept responsibility for:
• Undisclosed underground services
• Customer alterations
• Third-party damage
• Natural changes within gardens and outdoor environments
Nothing within these terms limits your legal consumer rights.
13. Data Protection and Privacy
Waterscape Creations collects and processes personal information required to provide quotations, deliver services, process payments and communicate with customers.
All personal information is handled securely in accordance with UK GDPR and the Data Protection Act 2018.
Customer information will never be sold to third parties.

14. Changes to These Terms
Waterscape Creations reserves the right to update these Terms and Conditions when required.
The Terms and Conditions active at the time your quotation is accepted will apply to your project.
15. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
Any disputes will be subject to the jurisdiction of the courts of England and Wales.
